​Club Waiver

BY SIGNING THIS DOCUMENT, YOU ARE FREELY GIVING UP LEGAL RIGHTS. IF A PARTICIPANT IS UNDER THE AGE OF 18, THIS WAIVER MUST BE SIGNED BY THE PARTICIPANT'S PARENT OR LEGAL GUARDIAN. BY SIGNING THIS DOCUMENT AND CHOOSING TO UTILIZE THE CLUB'S FACILITIES, EQUIPMENT AND SERVICES, YOU AGREE TO ITS TERMS AND YOU AGREE TO GIVE UP LEGAL RIGHTS.

In consideration of my use of the services, equipment, and facility provided by Styles Fitness and Wellness, LLC d/b/a Styles Studios Fitness (the "Club"), I acknowledge, agree, and represent as follows:

ASSUMPTION OF RISK. I fully understand and acknowledge that use of the Club's facilities, equipment, services and programs (including weightlifting equipment, exercise machines, exercise classes online programs and personal training) involves an inherent risk of personal injury, including permanent disability and death. I ACKNOWLEDGE AND VOLUNTARILY ASSUME ALL RISKS involved with my use of the services, equipment, programs, and facility provided by the Club, including but not limited to physical injury, emotional injury, bodily injury, death, or disability that may be incurred by me, including, without limitation, injuries arising from: (i) use of any exercise or weightlifting equipment or machines, which may malfunction or break; (ii) participation in exercise classes or personal training services; (iii) use of the Club's facilities, including locker rooms and exercise rooms; (iv) the Club's maintenance (negligent or otherwise) of any equipment, facilities, or premises, (v) the Club's instruction, supervision, or selection of an exercise program or method (whether in-club or via remote means), (vi) slipping or tripping on the Club's premises, or (vii) injuries, disease, infection, or medical disorders resulting from exercising at the Club or presence on the Club's premises, including but not limited to: heart attacks, strokes, sprains, heat stress, broken bones, and torn or damaged tendons, ligaments, or muscles. I further assume all risks of damage, loss, or theft of any personal property. I understand these risks and in spite of these clearly stated risks, I elect to use the Club's services, programs, equipment and facilities of my own free will and accord and, as such, I assume all responsibility for any injury, death or disability that I may incur.

BIOLOGICAL SAFETY. I understand that the protection of my health and the health of others is important to the Club and to the other members of the Club. I agree that when using the Club Facilities, I will observe good personal hygiene, will stay home when ill or if I have a fever, will properly sanitize equipment after use in accordance with club procedures, and will otherwise take reasonable precautions to prevent the spread of communicable diseases. I acknowledge that the Club will utilize commercially reasonable cleaning and sanitation services and will utilize best practices for the health and safety of its members. However, the Club operates in a public space and I assume the risk of contracting illness and release the Club from any claims related to illness or death caused by pathogens which may be spread in public spaces and in particular in a physical fitness club environment, and specifically waive any claims against the Club related to illness, hospitalization, lost work, or death/disability caused by any communicable diseases, regardless of whether the same is contracted at the Club.

LIABILITY WAIVER & RELEASE: I expressly waive and release any and all liability, demands, actions, causes of action, suits, demands, and claims of any nature, whether in law or equity, that arise or may arise in any manner against the Club, its corporate managers and members, employees, agents, representatives, attorneys, and successors and assigns related to, resulting from, or in any way associated with my use of the Club's services, equipment, facilities, programs (in-club or via remote means) or premises, regardless of whether such injuries result, in whole or in part, from the negligence of the Club, including, without limitation, claims or suits, resulting from personal injury (including death).

INDEMNIFICATION / HOLD HARMLESS: I hereby agree to indemnify and hold harmless the Club, its corporate managers and members, employees, agents, representatives, attorneys, and successors and assigns from and against any and all liability, demands, actions, claims, damages, losses or expenses, including any attorney fees, legal expenses, and court costs, that directly or indirectly arise out of my use of the Club's services, equipment, facilities, or premises, regardless of whether the same result, in whole or in part, from the negligence of the Club, including, without limitation, claims or suits, resulting from personal injury (including death) or illness contracted in the Club facilities.

REPRESENTATIONS & ACKNOWLEDGEMENTS. (1) I affirm that I have no medical condition which may prevent me from using the Club's services, programs, facilities, or equipment, or which poses a health risk to other users of the Club. (2) I agree to follow all of the rules of the Club that are posted or provided and understand that it is my responsibility to exercise good judgment in my use of the Club's facilities and equipment. (3) I understand that the Club maintains the right to deny any person entry and participation in its sole discretion and may deny a person entry if believes that entry may jeopardize the safety of the person or any other patron. (4) I understand that this Release & Waiver shall be effective for the duration of my membership at the Club and shall be legally binding upon me, my heirs, my estate, assigns, legal guardians and personal representatives. (5) I UNDERSTAND THAT BY SIGNING THIS DOCUMENT I WAIVE FOR MYSELF AND MY RESPECTIVE REPRESENTATIVES, SUCCESSORS, AGENTS, AND ASSIGNS, THE RIGHT TO TRIAL BY JURY, the parties agreeing that any disputes will be resolved by a judge sitting in a court of Peoria County, Illinois.

TEXT & EMAIL ADVERTISEMENTS. By completing this form, I consent to receive email and SMS text alerts from the Club, even if such communications are considered advertisements, and confirm that I am the current subscriber or customary user of any phone number and email address that I submit. Text alerts may be sent using an automated dialling system. I understand that my consent is not a condition of purchasing any goods or services, and may be revoked at any time by responding STOP to any SMS text alert I receive or OPT OUT to any email message that I receive. Message and data rates may apply.

REMOTE PROGRAM SERVICES. The Club may from time to time offer Remote Program Services to allow Members the ability to participate in Club programs from remote locations, including their home. By signing this document, I consent to the Club's REMOTE PROGRAMS TERMS AND CONDITIONS, LIABILITY WAIVER, which is made a part of this Document.

PARENT/LEGAL GUARDIAN CONSENT. If the participant is a minor (under 18 years of age), the minor participant's parent or legal guardian is also required to sign this form. By signing this Release and Waiver of Liability Form, the parent or legal guardian expressly (a) grants permission to the named participant to use the Club's services, programs, and facilities; (b) understands, acknowledges and affirms all the statements, assurances and waivers contained herein, and (c) agrees to bind himself or herself, and the minor participant, to each of the foregoing provisions to the extent permissible by law.

The participant, if a minor, and the parent or legal guardian, expressly acknowledge that there are risks for teenage children participating in weight training and high intensity training programs, including but not limited to physical injury as a result of stress placed on joints and ligaments, muscle strains and tears, growth plate injuries, bone fractures, cartilage damage, and herniated disks. The participant and the parent or legal guardian voluntarily assume these risks and all other risks as set forth in this Release and Waiver of Liability and hereby release and waive all claims against this Club, its corporate managers and members, employees, agents, representatives, attorneys, and successors and assigns and shall indemnify and hold the same harmless from any and all loss, claim, injury, damage, or liability sustained or incurred by me or my child/ward arising directly or indirectly from my use of the Club's facilities, equipment, services and programs (including any remote programs).

I further acknowledge the following: (i) minors under 15 years of age must be accompanied by a parent or guardian at all times; (ii) minors under 12 years of age are not permitted to use the Club's facilities, equipment, services and programs (including remote programs); (iii) the Club may require successful completion of training, in the Club's sole discretion, prior to a minor's use of the Club's equipment; and (iv) the Club reserves the right to prohibit any person from using Club equipment if they are using it improperly.

I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THE RULES POSTED OR PROVIDED TO ME, THAT I UNDERSTAND THE RISKS INHERENT IN MY AND/OR MY CHILD'S/WARD'S USE OF THE CLUB'S SERVICES, FACILITIES OR PROGRAMS OR WHICH RISKS THE ORDINARY PRUDENT PERSON IS OR SHOULD BE AWARE. I FURTHER ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS RELEASE AND WAIVER OF LIABILITY AND FULLY UNDERSTAND THAT IT IS A RELEASE OF ALL LIABILITY AND A WAIVER OF ANY RIGHT THAT I MAY HAVE ON BEHALF OF MYSELF AND/OR MY CHILD/WARD TO BRING A LEGAL ACTION OR ASSERT A CLAIM FOR INJURY, DEATH OR LOSS OF ANY KIND AGAINST STYLES STUDIOS FITNESS, LLC.
